Terms & Conditions

• You must be at least 16 years of age to create an account on BS Clip.
• By creating an account you confirm that all information you provide is accurate and up to date.
• You are responsible for maintaining the security of your account password. BS Clip accepts no liability for unauthorised access to your account.
• You may not create more than one account. Duplicate accounts may be suspended without notice.
• BS Clip reserves the right to refuse, suspend, or terminate any account at its sole discretion.

• BS Clip is a two-sided marketplace. Filmers upload video clips captured at ski resorts, beaches and skate parks amongst other public spaces. Riders purchase those clips for personal use and social media sharing.
• BS Clip acts as a facilitator between Filmers and Riders. We are not the creator or owner of any content uploaded to the Platform.
• BS Clip reserves the right to modify, suspend, or discontinue any feature of the Platform at any time.

4.1 Purchasing Clips

• Riders may purchase clips listed on the Platform at the advertised price of $4.99 AUD per clip or other price filmers may choose.
• All clip purchases are final and non-refundable unless the clip is found to be materially different from its description.
• Upon purchase, Riders receive a personal, non-exclusive licence to download, share, and post the clip on their personal social media accounts.
• Purchased clips may not be resold, sublicensed, or used for commercial purposes without the express written consent of the original Filmer.
• Clips expire from public sale after 7 days. Clips already purchased remain accessible in your Library after expiry for another week so you will download purchases to your personal device.

4.2 Wallet & Payments

• Riders may add credit to their BS Clip wallet in amounts of $20, $50, or $100 AUD via Stripe.
• Wallet credits are non-refundable and have no cash value.
• Credits do not expire while your account remains active.
• Riders may also pay for individual clips directly by card where wallet balance is insufficient.
• All payments are processed securely by Stripe. BS Clip does not store card details.

4.3 Subscriptions

• Riders may subscribe to Clip Advanced ($4.99 AUD/month) or Clip Pro ($7.99 AUD/month) for enhanced features including face recognition alerts, unlimited watchlist notifications, and analytics.
• Subscriptions renew automatically each month until cancelled.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided.
• BS Clip reserves the right to change subscription pricing with 30 days notice.

4.4 Social Sharing

• Riders may share purchased clips to Instagram, TikTok, and other social media platforms.
• When sharing, Riders agree to credit the Filmer where reasonably possible.
• Riders must not share clips in a way that is defamatory, harmful, or in breach of any platform's community guidelines.

5.1 Content Ownership & Copyright

• You confirm that you are the original creator and copyright owner of all content you upload to BS Clip.
• You confirm that your content does not infringe the copyright, trademark, or intellectual property rights of any third party.
• By uploading content, you grant BS Clip a non-exclusive, worldwide, royalty-free licence to host, display, and distribute your content on the Platform for the purpose of facilitating sales.
• You retain full ownership of your content. BS Clip does not claim ownership of any content you upload.

5.2 Consent & Privacy

By uploading content featuring identifiable individuals, you confirm that:

• The footage was captured in a public or semi-public space such as a ski resort or skate park where participants have a reduced expectation of privacy; OR
• You have obtained express verbal or written consent from all identifiable individuals featured in the clip

You must not upload content that:

• Features individuals in private or sensitive situations
• Was captured without the knowledge of the subject in a context where privacy would be reasonably expected
• Is intended to embarrass, harass, or harm any individual
• Features crashes, falls, or accidents where the subject has not consented to the footage being sold

If a subject requests removal of content featuring them, you agree to cooperate with BS Clip's takedown process within 24 hours.

5.3 Protection of Minors

• You must not upload any content featuring individuals who are, or appear to be, under the age of 16 without verified parental or guardian consent in writing.
• If you are unsure of a subject's age, do not upload the content.
• Any breach of this clause may result in immediate account termination and referral to relevant authorities.

5.4 Resort & Location Filming Policies

• You are solely responsible for complying with all filming policies, permits, and regulations at the location where your content was captured.
• Many ski resorts and skate parks prohibit commercial filming without a permit. You confirm you have obtained any required permits before uploading commercially sold content.
• BS Clip accepts no liability for any breach of resort or venue filming policies by Filmers.

5.5 Content Standards

You must not upload content that contains:

• Nudity or sexually explicit material
• Graphic violence or distressing content
• Hate speech or discriminatory material
• Content featuring illegal activities
• Footage of individuals under 16 without verified parental consent
• Personal information of individuals without their consent

5.6 Revenue Share & Payouts

• Your revenue share percentage is determined by your current subscription tier: Free (70%), Clip Advanced (78%), Clip Pro (90%) of each clip sale.
• Revenue share is calculated on the net clip price after Stripe payment processing fees.
• Earnings accumulate in your BS Clip account and are paid out in weekly batches every Monday via Stripe Connect to your nominated bank account.
• You are solely responsible for reporting and paying all applicable taxes on income earned through the Platform. BS Clip does not withhold tax on your behalf.
• Payouts require a connected Stripe Connect account with valid bank details. BS Clip accepts no liability for failed payouts due to incorrect banking details.
• BS Clip reserves the right to withhold payouts pending investigation of any content or conduct breach.

• BS Clip includes social features allowing Users to add others to their Squad (users they choose to follow) and build a Crew (users who follow them).
• Users may not use Squad and Crew features to harass, spam, or intimidate other users.
• BS Clip reserves the right to remove Squad and Crew connections that violate these Terms.

• Clip Advanced and Clip Pro subscribers may use BS Clip's face and gear recognition features to find clips featuring themselves.
• By enabling face recognition, you consent to BS Clip processing facial imagery from your profile and from Platform content for the sole purpose of matching you to clips.
• Face recognition data is stored securely, used only for matching purposes, and is deleted when you close your account.
• BS Clip does not share biometric data with third parties.
• You may disable face recognition at any time in your account settings.

All Users must not:

• Use the Platform for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Platform
• Upload malicious code, viruses, or harmful content
• Impersonate any other person or entity
• Manipulate reviews, ratings, or engagement metrics
• Use automated tools to scrape or access the Platform without permission
• Circumvent any security or access control feature of the Platform

• The BS Clip name, logo, brand, and Platform design are the intellectual property of BS Clip and may not be used without express written consent.
• All User-generated content remains the intellectual property of its creator, subject to the licences granted in these Terms.

• BS Clip reserves the right to remove any content that breaches these Terms at any time without notice.
• Any User may report content using the in-app report function. Reports are reviewed within 24 hours.
• Any individual who appears in a clip without consent may request its removal via support@bsclip.com.
• BS Clip complies with the Australian Online Safety Act 2021 and will action removal requests from the eSafety Commissioner promptly.

• BS Clip collects and handles personal information in accordance with our Privacy Policy, available at bsclip.com/privacy.
• By using the Platform you consent to the collection and use of your personal information as described in our Privacy Policy.
• BS Clip does not sell personal information to third parties.

• BS Clip is provided "as is" without warranties of any kind, express or implied.
• BS Clip does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or harmful components.
• BS Clip accepts no liability for the content uploaded by Filmers, including any consent, privacy, or copyright issues arising from that content.
• BS Clip's total liability to any User is limited to the greater of: the total amount paid by that User to BS Clip in the 3 months preceding the claim; or $100 AUD.
• BS Clip accepts no liability for indirect, incidental, special, or consequential damages of any kind.
• Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence.

You agree to indemnify and hold harmless BS Clip, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your breach of these Terms
• Content you uploaded to the Platform
• Your use of the Platform in violation of any law
• Any third-party claims related to your content or conduct

• You may close your account at any time by contacting support@bsclip.com.
• BS Clip may suspend or terminate your account at any time for breach of these Terms, fraudulent activity, or extended inactivity.
• Upon termination, your content will be removed from public sale. Buyers who purchased your clips prior to termination retain access to those clips.
• Outstanding earnings owed to Filmers at the time of account closure will be paid in the next regular weekly batch.

• BS Clip may update these Terms from time to time.
• Material changes will be notified via email and in-app notification with at least 14 days notice.
• Continued use of the Platform after the effective date of changes constitutes acceptance of the updated Terms.

• These Terms are governed by the laws of New South Wales, Australia.
• Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of New South Wales.
• Before initiating legal proceedings, both parties agree to attempt to resolve any dispute through good faith negotiation for a period of 30 days.
